Jakarta – A circulating rumor has sparked public concern, claiming that starting in 2026, land without certificates—such as those under girik, verponding, or letter C—will be taken by the government. The Ministry of Agrarian Affairs and Spatial Planning/National Land Agency (ATR/BPN) has stepped in to deny this claim.

“The information stating that land under girik status will be confiscated by the government if not registered by 2026 is completely false,” clarified Asnaedi, Director General of Land Rights Determination and Land Registration (Dirjen PHPT), on Monday (June 30, 2025), at the ATR/BPN Office in Jakarta.

Girik and Old Land Rights Not Proof of Ownership, But Still Valid

Asnaedi emphasized that documents like girik, verponding, and other old rights are not considered legal proof of land ownership. However, they do serve as valid historical indicators of previous ownership or customary land rights.

“These documents may be used for land recognition, affirmation, and conversion based on regulations outlined in Law No. 5/1960 on Agrarian Principles (UUPA),” he explained.

He also reiterated that the state will not confiscate land that still has girik status or similar documents. “If the land exists, the document exists, and the person still controls the land, there is no reason for the state to seize it,” he stressed.

2026 Deadline Doesn’t Mean Confiscation

According to Government Regulation No. 18 of 2021, particularly Article 96, landowners with former customary land documents are required to register their land within five years of the regulation’s enforcement—which points to a deadline in 2026.

However, Asnaedi made it clear that failing to meet the deadline does not result in automatic confiscation. Rather, it is part of the government's effort to encourage legal land registration.

Asnaedi urged the public to stay calm and proactive, saying this is a moment to secure their land legally by obtaining a certificate.

“The government’s role is to provide legal certainty—not to take people’s land,” he concluded.
